The summary in English: This article examines the most problematic issues concerning the legal classification of crimes involving road traffic and vehicle operation. Particular attention is paid to the relationship between Article 264 and Articles 264.1–264.3 of the Criminal Code of the Russian Federation, the evidentiary aspects of establishing intoxication, the qualifying element of leaving the scene of a traffic accident, and the application of administrative prejudiciality. The article analyzes shifts in judicial interpretation—specifically those enshrined in Resolution No. 21 of the Plenum of the Supreme Court of the Russian Federation dated June 25, 2024—as well as the Supreme Court’s case law from 2021 to 2026. The author concludes that a consistent classification algorithm is required, based on establishing the type of vehicle, the specific rule violated, the causal link, the legal status of the offender, and the form of culpability.
