Аннотация на русском языке: В статье исследуется правовая природа института условно-досрочного освобождения (ст. 79 УК РФ) и замены наказания более мягким видом (ст. 80 УК РФ). Автор отстаивает позицию, согласно которой данные институты представляют собой субъективное право осуждённого, возникающее при достижении целей наказания и выполнении совокупности объективных, проверяемых критериев. В работе проведён анализ судебной практики 2020–2025 годов, выявлены типичные нарушения требований мотивированности и правил доказывания при отказе в удовлетворении ходатайств. Предложена система объективных критериев, позволяющих перевести оценочные суждения об «исправлении» в плоскость документально подтверждённых фактов. Сформулированы предложения по совершенствованию разъяснений Верховного Суда РФ и правоприменительной практики, направленные на обеспечение предсказуемости и справедливости решений.
The summary in English: The article examines the legal nature of the institution Parole ( Article 79 of the Criminal Code of the Russian Federation) and commutation of sentence to a more lenient one ( Article 80 of the Criminal Code of the Russian Federation). The author argues that these institutions represent a subjective right of the convicted person, arising when the goals of the sentence are achieved and a set of objective, verifiable criteria are met. The paper analyzes judicial practice from 2020-2025 , identifying typical violations of the requirements of justification and evidentiary rules when denying petitions. A system of objective criteria is proposed that allows for the translation of value judgments about “correction” into the realm of documented facts . Suggestions are formulated for improving the clarifications of the Supreme Court of the Russian Federation and law enforcement practice , aimed at ensuring the predictability and fairness of decisions.
