The summary in English: Within the framework of this study, it is proposed to consider the subjective limits of pre-judiciality as a property of the legal force of an arbitral court decision.
The moment when the range of facts included in the subject of proof in a case can be referred to without the obligation to prove it is the moment when a judicial act enters into force. This is due to the fact that only when an act (primarily a court decision) enters into force does it fully acquire all the properties of an act of justice aimed at protecting or ensuring the rights and legitimate interests of the participants in the process.
At the same time, the current procedural legislation does not provide a direct answer to the question of determining the circle of persons to whom the preclusive property of a judicial act as an act of justice that has entered into force applies. Therefore, the author has chosen the institution of preclusion as the subject of this study.
The relevance of the chosen topic lies in the legal uncertainty regarding the definition of the circle of persons subject to the subjective limits of prejudiciality.
The methodological basis of the study is general scientific (analysis, synthesis, generalization, induction, deduction, and the historical method) and private scientific methods of cognition (dialectical, comparative legal, and formal-logical) in their various combinations.
Based on the analysis of legislation, doctrine and judicial practice, the following conclusion was made: the concept of prejudice should be disclosed through the property of the legal force of a judicial act, which is expressed in an imperative order for the court to be guided by previously established facts within another process without additional verification. Prejudiciality acts in relation to the circle of persons involved in the original case and is aimed at ensuring procedural economy and, to some extent, stability of civil circulation. At the same time, it is important to distinguish between the effect of preclusion and the principle of legal certainty of court decisions, which applies in cases where persons who were not involved in the previous process are involved in the case.
