Аннотация на русском языке: Статья посвящена исследованию института досудебного соглашения о сотрудничестве применительно к уголовным делам о незаконном обороте наркотиков. Анализируются правовая природа соглашения, критерии оценки его действенности, а также правовые последствия выполнения или невыполнения обязательств. На основе анализа судебной практики и научных позиций выделены три обобщенных критерия оценки сотрудничества: характер и объем содействия, объективность и последовательность показаний, а также отсутствие отягчающих обстоятельств. Выявлен новый тренд судебной практики (с января 2026 года), связанный с объединением эпизодов по ст. 228.1 УК РФ в единое продолжаемое преступление при наличии единого умысла. Сформулированы предложения по совершенствованию уголовно-процессуального законодательства, включая закрепление самостоятельного источника доказательств и регламентацию порядка расторжения соглашения.

The summary in English: The article examines the institution of the pre‑trial cooperation agreement in the context of criminal cases related to illegal drug trafficking. The study focuses on the legal nature of the agreement, criteria for assessing its effectiveness, and the legal consequences arising from the fulfilment or breach of the agreed obligations. Based on an analysis of judicial practice and scholarly positions, the paper identifies three generalised criteria for evaluating the cooperation provided: the nature and extent of assistance rendered, the objectivity and consistency of the statements given, and the absence of aggravating circumstances. The research reveals a recent trend in judicial practice (from January 2026 onwards) concerning the consolidation of separate episodes under Article 228.1 of the Criminal Code of the Russian Federation into a single continuing crime when a unified intent is established. The article also formulates proposals to improve the criminal procedure legislation, in particular, by establishing the cooperation agreement as an independent source of evidence and introducing a regulated procedure for terminating such agreements.
