The summary in English: The article examines the current problems of criminal law regulation of illegal arms trafficking, which are caused both by gaps in legislation and by the dynamics of criminal activity. The relevance of the topic is related to the high public danger of illegal arms trafficking, which contributes to the growth of violent crime, poses threats to national security, and is often associated with the activities of organized and transnational criminal groups.
The study identified several key problems. Firstly, there are terminological and qualification uncertainties in the legal regulation. For example, the Federal Law "On Weapons" defines the concept of "arms trafficking," but the Criminal Code of the Russian Federation (in particular, Article 222) does not specify the characteristics of individual actions (such as sale, storage, or transfer), which leads to discrepancies in judicial practice and difficulties in qualifying crimes. Secondly, the methods of committing crimes are rapidly evolving and outpacing the development of legal frameworks mechanisms. Additionally, the proliferation of technologies like 3D printing allows for the production of weapon components that bypass traditional control procedures, and current regulations do not fully account for the specific nature of such activities and their forensic detection. Thirdly, the effectiveness of countering illicit trafficking is negatively affected by organizational and interagency problems, such as fragmented accounting, insufficient automation of control processes, gaps in information exchange between agencies, and difficulties in coordinating international investigations of cross-border supply channels.
