Аннотация на русском языке: В настоящей статье рассматриваются вопросы про цессуальной самостоятельности следователя в уголовном процессе Российской Федерации, а также проведён анализ пределов полномочий следователя. Процессуальная самостоятельность следователя играет ключевую роль в обеспечении справедливости и эффективности уголовного процесса. Несмотря на процессуальное закрепление самостоятельности следователя в статье 38 Уголовно-процессуального кодекса Российской Федерации на практике данный ключевой участник уголовного процесса весьма ограничен, а его мнение нередко игнорируется руководителем следственного органа, имеющим иную точку зрения по текущему процессуальному вопросу. Возможность же оспаривания территориальным следователем принятого руководителем следственного органа решения сталкивается с должностной подчиненностью в духе единоначалия, а военным следователем в строгом порядке единоначалия.

The summary in English: This article examines issues of investigator procedural independence in criminal proceedings in the Russian Federation and analyzes the limits of investigator authority. Investigator procedural independence plays a key role in ensuring the fairness and effectiveness of criminal proceedings. Despite the procedural enshrinement of investigator independence in Article 38 of the Criminal Procedure Code of the Russian Federation, in practice, this key participant in criminal proceedings is quite limited, and their opinion is often ignored by the head of the investigative body, who has a different view on the current procedural matter. The ability of a territorial investigator to challenge a decision made by the head of the investigative body clashes with the official subordination system, which is based on the principle of one-man command, while the ability of a military investigator to challenge a decision made by the head of the investigative body clashes with the principle of one-man command.
