Аннотация на русском языке: В статье рассматриваются актуальные вопросы института мирового соглашения в гражданском процессе. Анализируется действующая нормативно-правовая база (статьи 153.8–153.11 ГПК РФ), а также позиции высших судов и научная доктрина последних лет. Особое внимание уделяется проблемам практической реализации института: процессуальным трудностям (обязательное участие сторон в судебном заседании, проверка условий соглашения и т.д.), доказательственным аспектам (ограниченность проверки фактов судом), вопросам исполнения соглашения и защиты интересов третьих лиц, а также учету публичных интересов при заключении «мира». В результате выявлены основные причины недоработок законодательства и практики, предложены пути их преодоления. В исследовании приведена сравнительная таблица проблем и решений, а также схема процедуры заключения и утверждения мирового соглашения в суде.

The summary in English: The article discusses current issues of the institution of a settlement agreement in civil proceedings. It analyzes the current legal framework (Articles 153.8–153.11 of the Code of Civil Procedure of the Russian Federation), as well as the positions of higher courts and the scientific doctrine of recent years. Special attention is paid to the practical implementation of the institution: procedural difficulties (mandatory participation of the parties in court proceedings, verification of the terms of the agreement, etc.), evidentiary aspects (limited verification of facts by the court), issues of execution of the agreement and protection of the interests of third parties, as well as consideration of public interests when concluding a settlement agreement. As a result, the main causes of shortcomings in legislation and practice have been identified, and ways to overcome them have been proposed. The study provides a comparative table of problems and solutions, as well as a diagram of the procedure for concluding and approving a settlement agreement in court.
