Аннотация на русском языке: В статье проводится комплексный анализ правового регулирования сторон, существенных условий и формы договора строительного подряда в Российской Федерации. Исследуются теоретические подходы к определению субъектного состава договорных отношений в сфере строительства, анализируются дискуссионные вопросы о перечне существенных условий договора строительного подряда.

The summary in English: The article provides a comprehensive analysis of the legal regulation of parties, essential terms and form of construction contracts in the Russian Federation. The theoretical approaches to determining the subjects of contractual relations in the construction sphere are examined, and debatable issues regarding the list of essential terms of construction contracts are analyzed. Particular attention is paid to the problem of classifying the price condition as an essential term of the contract.
