Аннотация на русском языке: В статье исследуются правовые проблемы управления многоквартирными домами в Российской Федерации с акцентом на исторически обусловленные модели поведения собственников и нанимателей при реализации ими своих прав и законных интересов иных лиц, участвующих в управлении многоквартирными домами. Обосновывается тезис о том, что историзм в правовом поведении выступает самостоятельным фактором, ограничивающим эффективность нормативно закреплённой модели коллективного управления общим имуществом. Анализируются последствия несоответствия между действующей правовой конструкцией управления домом и фактическим поведением участников жилищных правоотношений, проявляющиеся в формализации управленческих процедур, снижении роли общего собрания собственников и воспроизводстве конфликтной модели управления. Делается вывод о необходимости учёта историзма поведения как объективного предела правового регулирования и важного условия повышения эффективности управления многоквартирными домами.

The summary in English: The article examines the legal problems of apartment building management in the Russian Federation with a particular focus on historically conditioned patterns of behavior of owners and tenants in exercising their rights and legitimate interests of other participants involved in the management of apartment buildings. The author substantiates the thesis that historical inertia in legal behavior constitutes an independent factor limiting the effectiveness of the statutory model of collective management of common property. The study analyzes the consequences of the discrepancy between the normative legal framework governing apartment building management and the actual behavior of participants in housing relations, manifested in the formalization of management procedures, the reduced role of the general meeting of owners, and the reproduction of a conflict-based management model. It is concluded that taking into account behavioral historicism is essential for understanding the limits of legal regulation and for improving the effectiveness of apartment building management.
