Аннотация на русском языке: В статье рассматривается вопрос законной защиты прав лиц-взыскателей в ходе исполни-тельного производства. Обоснована необходимость защиты прав лиц, осуществляющих взыскание. Определен субъектный состав данной категории правовых споров. Проведен анализ нормативно¬правовой базы и обнаружена недостаточная проработанность в урегулировании практических воз¬можностей защиты данных прав. Акцентировано внимание на том, что существующие правовые нормы не наделяют судебных приставов необходимыми полномочиями. Разработаны и предложены на рассмотрение авторские изменения в законодательство об исполнительном производстве.

The summary in English: The article deals with the issue of legal protection of the rights of claimants in the course of enforce¬ment proceedings. The necessity of protecting the rights of persons carrying out the collection is justified. The subject composition of this category of legal disputes has been determined. The analysis of the regulato¬ry framework has been carried out and insu fficient elaboration has been found in the regulation of practical possibilities for the protection of these rights. Attention is focused on the fact that the existing legal norms do not give bailiffs the necessary powers. Author's amendments to the legislation on enforcement proceedings have been developed and proposed for consideration.
