Аннотация на русском языке: Работа посвящена анализу правовых особенностей договора аренды зданий и сооружений. Рассмотрены понятие и правовая природа такого договора, основные условия, права и обязанности сторон, особенности государственной регистрации и прав третьих лиц, ответственность арендатора и арендодателя, вопросы субаренды и переуступки, а также проблемные вопросы при расторжении договора и при передаче имущества. В работе проанализирована действующая нормативная база, даётся обзор судебной практики с приложениями ключевых решений. Рекомендованы способы минимизации рисков при заключении и исполнении договоров аренды зданий и сооружений.

The summary in English: The paper is devoted to the analysis of the legal features of the lease agreement for buildings and structures. The concept and legal nature of such an agreement, the basic conditions, the rights and obligations of the parties, the specifics of state registration and the rights of third parties, the responsibility of the lessee and the lessor, the issues of sublease and assignment, as well as problematic issues in the termination of the contract and the transfer of property are considered. The paper analyzes the current regulatory framework, provides an overview of judicial practice with applications of key decisions. Recommended ways to minimize risks when concluding and executing lease agreements for buildings and structures.
